Heller comes up for argument this coming Tuesday (18 March 2008). It is to be hoped that the Supreme Court will make a clear, strong statement one way or the other on whether or not the 2nd Amendment guarantees an individual right to keep and bear arms. Of course, almost everyone reading TLE believes that RKBA is a natural, God given right, an inherent and necessary condition of being human.

We don't need no stinkin' court decision to say so either.

However...

I want a "machine gun and mortars" decision, one that clearly puts those who would use thousands of stupid little laws and bureaucratic policies to achieve victim disarmament on the defensive. the stronger decision that comes out now, the faster we can destroy their Lilliputian skein of restrictions on our right at a lower cost in court fees and lobbying.

Secondly a favorable decision would help support the premise that the Bill of Rights cannot be reinterpreted out of existence.

Thirdly, it would force the candidates for Federal office to speak up about their opinions on gun control. While Mr. McCain and the two possible rivals the Democrats will sic on him are not real strong RKBA supporters, it will be fun to see them dance around the issue. I suspect it will be a spectacle the likes of which haven't been seen since Sally Rand retired from performing ecdysiastic displays.

More importantly, it will give you a chance to see how the candidates for the House of Representatives and Senate stand. Ever since the NRA orchestrated the removal of some 40 members of the House of Representatives over the ugly gun ban back in '94 candidates for Congress have been real mealy mouthed about how they feel about RKBA and what legislation they want.

A strong decision in Heller will force them to make a stand.

Sometime last year I got the impression that Heller would not be decided until after the 2008 Election and sent correspondence to TLE based on that error. Since it now appears that the decision will come out before the election we will get to see how politicians react to it and we can use this information to determine if these candidates can be trusted to respect the right spelled out in the Second Amendment and indeed the entire Bill of Rights.
